Terms of Service

Welcome to Bare Bites & Beverages. These Terms of Service (“Terms”) govern your use of our website and online ordering service (the “Service”). By using the Service or placing an order, you agree to these Terms. Please read them carefully — Section 14 requires disputes to be resolved by binding arbitration on an individual basis, and includes an option to opt out.
1. Who may use the Service
You must be at least 18 years old (or the age of majority where you live) to place an order and make a payment. If you are under 18, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
2. The Service
Bare Bites & Beverages is a mobile food truck. Our website provides menu information, our schedule, and online ordering for in-person pickup at a scheduled truck stop. We do not offer delivery. By placing an order, you agree to pick it up at the location and time window you select.
3. Ordering & pickup
When you order, you choose a pickup stop and time slot. Preparation lead times and order cutoffs may apply and are reflected in the times available at checkout. Please arrive during your selected window. Orders not picked up may be discarded for food-safety reasons without a refund.
4. Pricing, taxes & fees
Menu prices are listed in U.S. dollars and do not include taxes or fees. At checkout, before you confirm payment, we add applicable sales tax and a card processing fee, and the full total is shown to you. As of the date above, that is 7% sales tax and a 3% card processing fee. These rates are set in our payment system and may change; the amount displayed at checkout is the amount you authorize. By completing checkout you agree to the total shown.
5. Payment
Payments are processed by Square, Inc. on a secure hosted checkout page. We do not receive or store your card details. By completing a purchase, you authorize the charge to your chosen payment method for the total shown.
6. Cancellations & refunds
Because all items are made to order, we generally cannot accept cancellations once an order is confirmed and paid. If we are unable to fulfill your order due to circumstances such as a cancelled stop, equipment failure, or weather, we will refund your payment to the original method, typically within 5–7 business days. If you have a quality issue with your order, contact us and we will work to make it right.
7. Order accuracy
Please review your order before submitting. We prepare items as specified at checkout, including customizations. We are not responsible for errors resulting from inaccurate information you provide.
8. Allergies & dietary restrictions
Our food is prepared in a shared kitchen that handles common allergens, including tree nuts, peanuts, dairy, eggs, wheat/ gluten, soy, and fish/shellfish. Cross-contact is possible, and we cannot guarantee that any item is free of any allergen. If you have a food allergy or sensitivity, please contact us before ordering and order at your own risk.
9. Scheduled stops
Stop schedules may change due to weather, private events, equipment issues, or other circumstances. We make reasonable efforts to communicate changes through our social media channels, but we are not liable for inconvenience caused by changes, delays, or cancellations of stops.
10. Intellectual property
The Bare Bites & Beverages name, logo, brand imagery, text, and other site content are owned by or licensed to Bare Bites & Beverages and are protected by applicable law. You may not copy, reproduce, or use them without our prior written permission.
11. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the fullest extent permitted by law, Bare Bites & Beverages and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service or any order. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Bare Bites & Beverages from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms.
14. Dispute resolution & binding arbitration
Please read this section carefully — it affects your legal rights.
Informal resolution first. Most concerns can be resolved quickly. Before starting arbitration, you agree to contact us and give us 30 days to try to resolve the matter informally.
Binding arbitration.If we can't resolve a dispute informally, you and Bare Bites & Beverages agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as provided below. The arbitration will take place in or near Marion County, Florida, or by phone/video where available.
Class-action waiver.Disputes will be conducted only on an individual basis. You and Bare Bites & Beverages waive any right to bring or participate in a class, collective, or representative action.
Small-claims & exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court for intellectual-property or unauthorized-use matters.
Your right to opt out. You may opt out of this arbitration agreement by emailing barebitesbeverages@gmail.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
15. Governing law & venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. To the extent any dispute proceeds in court rather than arbitration, it will be brought exclusively in the state or federal courts located in Marion County, Florida, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new date. Your continued use of the Service after changes take effect means you accept the revised Terms.
